Welcome to SoberJobs. For this agreement, "Site" refers to SoberJobs.com, operated by MyNew Technologies, LLC. "Service" refers to the Site's services. "We," "us," and "our" refer to MyNew Technologies, LLC. "You" refers to you as a user of the Site or Service.

Please review the following terms carefully. By accessing or using the Service, you agree to these Terms. If you do not agree, you may not access or use the Service.

We respect the privacy of our users. Please refer to our Privacy Policy to understand how we collect, use, and disclose information. By using the Service, you agree to the Privacy Policy as well as these Terms.

About the Service

SoberJobs is a job board connecting job seekers with recovery-friendly employers. Employers may register accounts, subscribe to plans, and post job listings; job seekers may search and apply to listings free of charge.

Registration and User Conduct

You must be at least 13 years old and a resident of the United States to register for and use the Service. If you register for an employer account, you will create a personal profile including a username and password. You agree to notify us immediately of any unauthorized use of your account. We are not responsible for losses arising from unauthorized use of your account credentials.

Use restrictions

You agree that you will not, under any circumstances:

• Use the Site or Service for any purpose other than your personal use or legitimate hiring activity as intended by the Service's normal functionality;
• Collect or harvest personal data of other users;
• Post fraudulent, misleading, or non-existent job listings;
• Distribute any part of the Site without our written permission (search engine indexing is permitted);
• Use the Service for unlawful purposes or to promote illegal activity;
• Harass, abuse, or harm another person or group;
• Use another user's account without permission, or allow another user to access your account;
• Provide false or inaccurate information when registering;
• Interfere with the proper functioning of the Service;
• Use automated tools to scrape, spider, or crawl the Service, or impose an unreasonable load on our infrastructure;
• Bypass robot exclusion measures or other access restrictions; or
• Publish or link to malicious content intended to damage or disrupt another user's device.

Posting and Conduct Restrictions

When you create an account, you may provide your name, email address, phone number, and (for employers) job listing content ("User Content"). You are solely responsible for the User Content you submit. We act only as a passive conduit for User Content but reserve the right to remove any content at our sole discretion.

By submitting User Content, you agree that:

• You are responsible for your account and all activity that occurs while signed in;
• You will not post information that is malicious, false, or inaccurate;
• You will not post content that is abusive, threatening, obscene, defamatory, or otherwise objectionable;
• You retain ownership of your User Content, but grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, and display that content in connection with providing the Service;
• You will not submit content subject to third-party proprietary rights unless you own those rights or have permission; and
• We may determine whether your submissions comply with these Terms, remove submissions, and terminate your account with or without notice.

Online Content Disclaimer

Job listings and other content made available through the Service but not authored directly by us are the responsibility of their respective authors (typically employers). We do not guarantee the accuracy, completeness, or usefulness of any listing or other content, and we are not responsible for any loss resulting from reliance on content posted via the Service.

We reserve the right, but have no obligation, to monitor content on the Service and to remove or restrict access to content that violates these Terms or applicable law.

Links to Third-Party Sites

The Service may link to third-party websites or applications. We have no control over and are not responsible for the content, accuracy, or privacy practices of those third-party sites. Accessing third-party sites is at your own risk, and the terms of this Agreement no longer govern once you leave the Site.

Copyright Complaints and Copyright Agent

We respect the intellectual property rights of others and expect users to do the same. Under 17 U.S.C. § 512(i), we have adopted a policy of terminating, in appropriate circumstances, accounts of users who are repeat copyright infringers.

DMCA takedown notices

If you are a copyright owner or authorized agent and believe material on the Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) to our designated copyright agent at the address below, including:

• The date of your notification;
• A physical or electronic signature of a person authorized to act on behalf of the rights owner;
• A description of the copyrighted work claimed to be infringed;
• A description of the allegedly infringing material and information sufficient for us to locate it;
• Your contact information (address, phone, email);
• A statement of good-faith belief that the use is unauthorized; and
• A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the rights owner.

Counter-notices

If you believe content you posted was removed in error or misidentification, you may submit a counter-notice including: your signature; a description of the removed content and its prior location; a statement of good-faith belief the removal was a mistake; and your contact information, along with a statement consenting to jurisdiction of the federal court in California and acceptance of service of process from the original complaining party.

Upon receipt of a valid counter-notice, we may forward it to the original complaining party. Unless that party files a court action, the removed content may be reinstated in 10–14 business days, at our discretion.

License Grant

By posting User Content, you grant us a royalty-free, sublicensable, transferable, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, publish, distribute, and display that content, and your name and likeness as contained in it, in connection with the Service.

Intellectual Property

We and our licensors retain ownership of all intellectual property rights related to the Service, including applicable copyrights and trademarks. Other product and company names mentioned on the Service may be trademarks of their respective owners.

Electronic Communications

Communications made through the Service's email or messaging systems do not constitute legal notice in situations where notice is required by contract, law, or regulation.

By using the Service, you consent to receive communications from us electronically and agree that electronic Terms, agreements, notices, and disclosures satisfy any legal requirement that such communications be in writing. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. SOME JURISDICTIONS DO NOT PERMIT DISCLAIMERS OF WARRANTY, SO THIS PROVISION MAY NOT APPLY TO YOU.

Limitation of Damages; Release

TO THE EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY LOSS OF PROFITS, USE, OR DATA, OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE. If you have a dispute with another user, an employer, or a third party arising from your use of the Service, you release us from claims and damages of every kind arising out of or connected with such disputes, to the fullest extent permitted by law.

Modification of Terms

We may amend these Terms at any time. We will notify you of material changes by posting a notice on the Site, and your continued use of the Service after such notice constitutes acceptance of the revised Terms.

General Terms

If any portion of these Terms is found invalid or unenforceable, that portion will be construed to be consistent with applicable law, and the remaining portions will remain in full force. Any cause of action arising from your relationship with us must commence within one year after it accrues, or it is permanently barred.

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law provisions. We may assign these Terms or our Privacy Policy at any time without your consent; you may not assign your rights or obligations under these Terms without our prior written consent.
